We publish and maintain the website at apollosecure.com (the Website), the application at app.apollosecure.com (the App) as well as related services (the Services).

1.3. Apollo is committed to the protection of your personal information and has developed this Privacy Policy in line with the following data privacy regulations:
a) ‘Australian Privacy Principles’ as established under the Privacy Act, 1988 (Cth)
b) Regulation (EU) 2016/679 General Data Protection Regulations (GDPR)
c) California Consumer Privacy Act (CCPA)

1.4. This Privacy Policy is important. It applies to the collection, storage, disclosure, use and dissemination by Apollo and any related body corporate or affiliate of Apollo (Apollo Group) of your personal information obtained by your use of the Website, App and Services.

1.5. We may amend this Privacy Policy from time to time and will provide notice via the Website. If we make material changes to this Privacy Policy, we will notify you by email or by posting a notice prior to or on the effective date of the changes. We recommend you check this Privacy Policy occasionally to ensure you are aware of any changes. Your continued use of the Website, App and Services following any such amendment will be confirmation of your acceptance of the amendments.

1.6. Before you supply any Personal Information (as defined below) to Apollo or any member of the Apollo Group, please review this Privacy Policy. This Privacy Policy as amended from time to time on this Website will apply to your purchase and use of Apollo App and Services. We will not use your data beyond what we disclose in the Privacy Policy.

2. Collection of Personal Information

2.1. We collect and uses information that may personally identify you such as your name, email address, home address, location and contact telephone number (“Personal Information”). By using our App and Services, you consent to us collecting Personal Information about you. You may be able to limit or disallow Apollo from using or sharing sensitive personal information by emailing privacy@apollosecure.com and submitting a request to delete, correct or limit the sharing of your personal information.

2.2. We also collect aggregate information, which refers to information that does not alone identify a specific individual. This information refers to information based on where you visit our Website and App, which pages you click on, and what other websites may have directed you to us. We collect this information in various ways, and is compiled and analyzed on both an aggregate and personal basis. This information may include the website’s universal resource locator (“URL”) that points to the site you had come from, which URL you visited after visiting our Website, which type of browser you are using, and your Internet Protocol (“IP”) address.

2.3. Apollo does not wish to collect any information about you that is considered to be “sensitive information” under the Privacy Act, including information or opinions about your political affiliations, sexual preferences, religious beliefs, racial or ethnic origin. Your consent to our collection of such information is however given when you knowingly supply such information to any member of the Apollo Group or should you decide to submit such information to this Website or App. For the purposes of this Privacy Policy any such sensitive information will be included in each reference to Personal Information unless the context indicates otherwise. You may be able to limit or disallow Apollo from using or sharing sensitive personal information by emailing privacy@apollosecure.com and submitting a request to delete, correct, or limit the sharing of your sensitive personal information.

2.4. You have the right to withhold your name or to use a pseudonym in place of your real name to identify yourself when registering for the App, but you will appreciate that in some cases, such as the purchase of goods by means of a credit card, you will need to supply your real name.

2.5. Apollo collects Personal Information from you when you access our Website or when you use our App and Services. We may collect your Personal Information through on-line shopping purchases, in-store purchases, entry into trade promotions and competitions, subscribing to our newsletter, signing up as a member, creating a user account, sending ‘contact us’ messages or other correspondence through the Website, App or by post, through advertising, research and direct marketing and by other means including information you supply to third parties selling our App and Services.

2.6. If you choose to engage in communication with us that may be accessible by others, such as through social media, we strongly recommend that you don’t include any Personal Information. If any communication sent by you through public channels includes Personal Information, we can’t be held liable for any breach of privacy in doing so. To help protect your privacy, our preferred method for support is via email to privacy@apollosecure.com.

2.7. Apollo may collect Personal Information about you from other members of the Apollo Group, distributors, retailers, marketing partners and other service providers when you request information about our App and Services. This may include your name, email address and which App and Services you may be interested in.

2.8. Your Personal Information may also be collected by a third party supplier and you agree that such information may be passed onto us.

2.9. The Purposes for data processing are to enable us to:
(a) complete your retail transactions
(b) register and service your use of our App and Services
(c) deliver the features of the Website and App
(d) improve our service to you where possible
(e) enhance your use of the Website and App; and
(f) assist us to gain an understanding of your preferences and requirements in order that we can provide information, goods and services that are of interest to you.

2.10. Some of the information collected will not personally identify you but will instead track your use of the Website and App so that we can better understand how the Website and App are used by customers and in turn enhance and improve your experience in shopping on the Website and when shopping for the Apollo App and Services from third parties.

2.11. One of the means we use to track your use of the Website and App is by means of a ‘cookie’ stored on your computer by your web browser. On each visit to the Website or App, the Apollo web server will recognise the cookie and give Apollo information about your visit. The cookie does not contain information that personally identifies you and Apollo does not use cookies for that purpose. Apollo uses cookies to learn about your preferences and the way that you use the Website and App, so that it can improve the Website and App. Most browsers accept cookies automatically, but you should also be able to alter the settings of your browser to refuse cookies. The method for disabling cookies may vary by browser and device, but can usually be found in your browser or device preferences or security settings. You should note that de-activating cookies may mean that you will no longer be able to enjoy the full operational capabilities of the Website and App.

2.12. We will only collect Personal Information that is necessary for one or more of our stated requirements or functions. We will destroy or de-identify any Personal Information that is no longer needed including any Personal Information that is unsolicited or that we inadvertently collect and that is not necessary for our stated requirements or functions. We will destroy any Personal Information we hold about you which it no longer requires under the terms of this Privacy Policy. We may keep anonymous usage data indefinitely for the purpose of research and to improve our App and Services.

3. Storage and Security of Personal Information

3.1. Apollo will use its reasonable endeavours to protect and maintain the security of your Personal Information and to make the Website, App and Services as secure as reasonably possible against unauthorised access, modification or disclosure and against interference, misuse and loss. While we strive to use commercially acceptable methods to protect your personal information, Apollo does not guarantee its absolute security, as no method of dissemination of information through the internet is ever fully secure.  This includes the implementation of security software in our cloud infrastructure and following industry best practices for authorization, encryption and access controls. We also apply recommended security measures to our App and perform security reviews of our environment. Apollo officers, employees, agents and contractors are expected to observe the confidentiality of your Personal Information.

3.2. To assist Apollo with protecting all Personal Information, we request that you email us at privacy@apollosecure.com immediately if you become aware of any unauthorised use of your Personal Information in connection with the Website or App. We will confirm receipt of your complaint and advise you what steps will be taken to investigate the matter and endeavour to resolve the matter.

4. Use and Disclosure of Personal Information

4.1. By accepting this privacy policy, Apollo may send you messages or make contact with you by email, phone and/or SMS relating to your use of the App and Services.

4.2.  Apollo may disclose your Personal Information to any and all of the following where it is required to provide you the services:
(a) Any members of Apollo Group;
(b) To third party contractors, business partners, distributors, suppliers and other entities (Partners).

4.3. If you opt-in to receive marketing material, you accept that members of Apollo Group and/or our Partners may occasionally send you information about products, services, offers, research or other material which we believe may be of interest to you.

4.4. We do provide some of our App and Services through agreements with third-party service providers, affiliates, partners, and other types of third-parties (“Service Partners”). Our Service Partners and Apollo may need to use some personal information to perform our tasks between our websites or deliver the App and Services to you. We encourage our Service Partners to adopt and promote strong privacy policies that are compliant with all relevant privacy acts. However, the use of your personal information by our Service Partners is governed by their respective privacy policies and is not subject to our control. This document only addresses the use and disclosure of information we collect from you.

4.5. Members of Apollo Group and our Partners may be located both within and outside of the country you are located in, (the “Territory”) and you acknowledge that your Personal Information will be disclosed to and stored outside of the Territory in order to deliver the Services to you. We have implemented appropriate safeguards to ensure the privacy of your Personal Information is maintained and details of these safeguards can be provided upon request to our support team.

4.6. If you would like to unsubscribe from receiving direct marketing communications from Apollo or do not want us to share your Personal Information with any Partners, you may email us at privacy@apollosecure.com or follow the steps to unsubscribe which are presented in every email communication you receive from us. Apollo will comply with your request within a reasonable period of receipt of such request.

4.7. Apollo's use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

4.8 Apollo may use information about you to make decisions on our Website, App and Services to tailor your experience with us. You can choose to disable cookies or get in contact with us below if you choose not to be included.

5. Rights Over Your Personal Information

5.1. Apollo respects your right to control how we process your personal information, and as such you may exercise the following rights over your personal information:
a) Right to access to the personal information which Apollo has collected about you through the Website, App and from third party sources
b) Right to correct your personal information by amending your details on the Website or App, or by contacting us
c) Right to request deletion of your personal information in certain circumstances
d) Right to temporarily suspend the processing of your personal information
e) Right to take your data with you
f) Right to object to processing in certain circumstances
g) Right to opt-out of automatic decision making

5.2. You have choices with respect to cookies, as described above. You can modify your browser preferences to accept all cookies, accept only some cookies, to be notified when a cookie is set, or reject all cookies.

5.3. You can access and edit your personal information that you have provided to us. You may change any of your personal information in your online account by linking to your account with instructions posted on the Website or App. You may also access and/or correct your personal information and/or privacy preferences by emailing us at privacy@apollosecure.com.

5.4. You can contact us directly at privacy@apollosecure.com to exercise any of your rights under the GDPR. We may require you to provide particulars of your identity before acting on your request. In certain circumstances, we can reject your request to exercise your rights, in such a case we will let you know and provide you with the reasons why.

6. Children's Privacy

6.1. Apollo's Website and App are not intended for use by anyone under the age of 18. We do not knowingly collect personal information from children under 18 years of age. If you are under 18, please do not use our services and do not provide any personal information to us.

6.2. If you are a parent or guardian and believe that your child under the age of 18 has provided us with personal information without your consent, please contact us at privacy@apollosecure.com, and we will take steps to remove that information from our servers.

6.3. Apollo does not target its App or Services to minors under the age of 18, and does not knowingly collect personal information from children under this age. We are committed to protecting the privacy of children and encourage parents and guardians to take an active role in their children’s online activities and interests.

7. Disclaimer

7.1. We will only collect, use or disclose your Personal Information as follows:
a) in compliance with this Privacy Policy;
b) to comply with any applicable law;
c) to protect the rights or property of any member of Apollo Group; or
d) for confidential dispute resolution processes.

7.2. You may link directly to Websites operated by Partners (Linked Websites) from the Website or App. Although certain Linked Websites may be co-branded with the Apollo logo or name, you acknowledge that such Websites may not be operated or controlled by Apollo.

7.3. Company Linked Websites may collect your Personal Information. You acknowledge that Apollo is not responsible for the privacy Policy (if any), content or practices of the Linked Websites. We encourage you to always read the applicable privacy policy of any Linked Website.

7.4. We may retain information to prevent, investigate, or identify wrongdoing in connection with the App and Services provided by Apollo or to comply with legal obligations. We may also maintain residual copies of your personal information in our backup systems.

7.5. We may be required by law enforcement or other judicial authorities to provide personal information to the governmental authorities. In those instances, we will disclose your information upon the receipt of a court order or subpoena, or other reason to cooperate with a law enforcement investigation. We fully cooperate with the law enforcement agencies to identify anyone using our Services for illegal activities and we retain the right to report any suspicion of illegal activities to law enforcement agencies if we have good faith reason to believe in such activity in being unlawful.

8. California Residents: Your California Privacy Rights

8.1. Under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (“CCPA”), California residents have certain rights surrounding Apollo collection, use, and sharing of personal information. As of January 1, 2023, you have the right to opt-out of sharing your personal information with third parties in relation to targeted advertising, which you can so request at privacy@apollosecure.com.

8.2. Additionally as of the date above, you have the right to request correction of any inaccurate personal information and to request Apollo limit the disclosure and use of any personal information Apollo may have collected in the last 12 months. If you are a California resident, you have the right to request to know what personal information has been collected about you, and to access that information.

8.3. Additionally, you have the right to request deletion of your personal information, though exceptions under the CCPA may allow Apollo to retain and use such personal information.

8.4. Please note Apollo will not discriminate against you for exercising your rights under the CCPA. Separate from the CCPA, California’s Shine the Light Law allows California residents the right to ask companies what personal information they share with third parties for those third parties’ direct marketing purposes.

8.5. If you have any questions regarding this policy, or would like to change any preferences, you may contact us at privacy@apollosecure.com. Apollo will respond to any requests within 45 days, either providing the information, or may provide a detailed explanation in relation to what information may be released or what cannot because it may be protected by law. This time period may be extended by an additional 45 days so long as Apollo provides notice to you within the first 45-day period. If a request is being made that is not clear, Apollo may request clarification in order to respond correctly.

9. European Residents: Your Privacy RIghts and International Data Transfer

9.1. For users in the European Union, Apollo adhere’s to the Regulation (EU) 2016/679 of the European Parliamant and of the Council of 27 April 2016, known as the General Data Protection Regulation (“GDPR”). If you are a European resident, you have the right to access your personal data, and the right to request that Apollo correct, update, or delete your personal data. You can object to the processing of your personal information, ask us to restrict processing your personal information, and request portability of your personal information. If you have previously consented to the processing of your personal information, you have the right to withdraw consent at any time. If you wish to withdraw your consent, Apollo’s lawful prior processing of your personal information conducted in reliance of your consent shall not be impacted. 9.2. Our legal basis for collecting and using the information described above will depend on the specific information and the context in which Apollo collects such information. We will collect personal information from you only when we are provided with consent to do so, where personal information may be needed to perform a contract, or where processing the information is in legitimate business interests and does not override your data protection interest or your fundamental rights or freedoms. We may also collect personal information if we have a legal obligation either to you or protect the interests of another person. If we request personal information from you to comply with a contract or legal obligation, we will clearly state this in the contract or at the relevant time. If we collect and use your personal information in reliance of legitimate business interests or those of a Partner, this interest will be communicated to you. 11.1. By accepting this privacy policy, you acknowledge that the Apollo Group, our Partners and each of their officers, employees, agents and contractors are permitted to collect, store, use and disclose your Personal Information in order to provide you with the App and Services, in the manner set out in this Privacy Policy.

11.2. In the event of a merger, acquisition or sale of the whole or part of the business of Apollo, we reserve the right to transfer your Personal Information as part of any such transaction.
